GN 00302.485 Evidence Establishes Only Age

A. General

If the evidence shows only the individual's age at a given time and does not show the DB or at least the year of birth, we must ascertain whether the age was given as of the last, next, or nearest birthday to determine the individual's DB.

The age is usually given as of the last birthday in documents other than U.S. census records and insurance policies. Use the following chart to aid in determining when the age was given.

B. Rules

IF the age shown on the document is... AND... THEN...
Consistent with the DB alleged There is no evidence to the contrary Consider the age to have been given as of the last birthday.
 
Consistent with the DB alleged only if it was given as of the next birthday The difference between the 2 possible years indicated by the document is not material Do not undertake further development to resolve the difference.
 
 

 

There appears to be a reasonable explanation as to why the age might have been given as of the next birthday in the particular document involved

Do not undertake further development to resolve the difference.
