GN 01734.011 How the Luxembourg Agencies Develop Applications

A. Introduction

The agencies in Luxembourg take claims from individuals who want to file under the agreement. If the claimants want to file for U.S. benefits, the Luxembourg agencies notify OIO.

B. Process

The following instruction discusses the applications and evidence obtained by the Luxembourg agency offices that is forwarded to OIO.

1. U.S. Claim

If the claimant contacts a Luxembourg agency office to apply for U.S. benefits, the agency obtains a signed statement of intent to file for U.S. benefits and forwards it to OIO with a liaison form LUX/USA 3 and a Luxembourg coverage record.

2. Luxembourg Claim

If the Luxembourg agency needs a U.S. coverage record and/or entitlement data to complete the Luxembourg claim, the agency requests the information from OIO using form LUX/USA 3.

3. U.S. and Luxembourg Claim

If the claimant contacts a Luxembourg agency to apply for both U.S. and Luxembourg benefits, the agency obtains the required Luxembourg application form. The form asks for an indication of work in another country. If the claimant indicates work in the U.S., the Luxembourg agency notifies OIO using a liaison form.

The Luxembourg agency prepares and forwards the following material to OIO:

  • Liaison form LUX/USA 3, certifying the filing date and requesting a U.S. coverage record and/or entitlement data if it is needed.

  • Luxembourg coverage record.

  • Available medical evidence if the claim is for disability benefits.
