DI 10115.025 Childhood Disability Benefit (CDB) First Month of Entitlement (MOET)

A. Policy – MOET Deceased Wage Earner (WE)

An individual entitled to surviving child's benefits will be entitled (or reentitled) to a monthly benefit effective with the first month in which all of the requirements in RS 00203.001 are met during any part of that month.

B. Policy – MOET Living WE

An individual entitled (or reentitled) to child's benefits on the earnings record (E/R) of a living wage earner will be entitled to a monthly benefit effective with the first month in which all of the requirements in RS 00203.010 are met throughout the entire month, provided an application has been filed for that month. (It is not necessary for an application to be filed on the first day of a month, but merely that an application is filed for that month).

NOTE 1: There are exceptions to this “throughout the entire month” requirement for certain students, 216(h) (3) children, stepchildren, and dependent grandchildren or step grandchildren. These exceptions, with applicable cross references are covered in RS 00203.010B. The “throughout the entire month” requirement became effective for months after 8/81, for individuals who were not entitled to child's insurance benefits on any E/R for 8/81 or any preceding month.

NOTE 2: Prior to 8/81, the rules for entitlement or reentitlement of a child on the E/R of a living WE were the same as the rules for a child of a deceased WE.
