A person is considered blind if his visual acuity with best correcting lens is 3/60 or 10/200 or less in the better eye. He must undergo an examination for visual acuity as required by the Department. He has the choice of examination by a physician skilled in the disease of the eye or by an optometrist.

A person is “permanently and totally disabled” if he has a disability which meets the conditions specified in 3141.31 and 3141.32.

   “Permanent disability” (3141.31) means any physical or mental impairment that is substantiated by a medical diagnosis and which has lasted or is expected to last for a continuous period of not less than 12 months, or which can be expected to result in death.

   Alcoholism and drug addiction, like other anatomical, physiological or psychological abnormalities which meet the above criteria, are permanent disabilities.

   “Total disability” (3141.32) means inability to engage in any substantial gainful activity that exists in the community.

   “Substantial gainful activity” is any work of a nature generally performed for remuneration or profit, involving the performance of significant physical or mental duties or a combination of both.
