The effective date of the disqualifiers listed in VB 00205.200B, , second and third bullets, is the first day of whichever of the following months is earlier:

  The month in which a warrant, court order or decision, or order or decision by an appropriate agency (e.g., parole board) is issued that finds the individual is fleeing (or has fled) to avoid prosecution, or custody or confinement after conviction, for a crime described in VB 00205.200B, second bullet, or is violating (or has violated) a condition of his/her probation or parole; or

• •

  The first month during any part of which the individual fled to avoid prosecution, custody or conviction, or violated a condition of probation or parole, if indicated in such warrant, order or decision.

If the effective date of the disqualifying event is in, or prior to, the month in which the notice of qualification is dated, it results in denial of the claim.

If the effective date of the disqualifying event is after the month in which the determination on qualification was made, it is a suspension event.

Where the SVB application or other information indicates that one of the events listed in VB 00205.200A, second or third bullet, has occurred, check the SSR (and if necessary the SSI file) to determine whether the individual has been found to be ineligible for either of these reasons (code N25). If so, take action to deny the SVB claim or suspend benefits as appropriate.

Take action as explained in SI 00501.055 if the SSR and SSI file show no information on this will be added later.
