HA 01480.045 Processing Protest Cases After Court Remand

When an effectuating component or Regional Commissioner’s
office believes that an administrative law judge or Appeals Council (AC)
decision issued after a court remand cannot be effectuated, they may
refer the case to the AC. The AC will process the protest according to the
procedures in Hearings, Appeals and Litigation Law (HALLEX) manual chapter
HA 01360.010.
