GN 04060.065 Exception to Sending Notice of Revision to Parties

Recovery of overpayments from a beneficiary who was without fault will be waived in any case where the determination or decision that the services were noncovered was made in the fourth calendar year after the year in which the intermediary or carrier approved the payment. Where a revised determination or decision results in a finding of overpayment for which the beneficiary would be liable but it appears that the conditions for waiver described above are met, the intermediary or carrier does not send a notice of the revision to any party. Instead it refers the overpayment to HCFA for consideration of the waiver issue.
