RS 00202.075 Validity of Divorce or Marriage - Divorced Spouse
-
a.
Generally, the validity of a divorce need not be questioned.
-
b.
Proof of divorce may be needed. See GN 00305.140A.1. for when proof of divorce is required.
-
a.
A divorce presupposes that the marriage terminated by that divorce was a valid one.
Thus, proof of divorce also usually constitutes evidence of the validity of the divorced
spouse's marriage to the NH.
-
b.
Proof of validity of the marriage is required when:
-
•
Development is necessary to establish the validity of the claimant's divorce from
the NH; or
-
•
Information raises a reasonable doubt of the validity of the marriage.
