SSA and DDS have an agreement that the DDS may transfer jurisdiction to ODO/FDU or
PSC/DPB for a quicker disability determination if there is a large number of pending
disability claims. See Cases to be Processed By DPB - SSI Emergency Clause Case -
DI 11055.110 for Title XVI claims). The agreement specifies the effective period of time and the
type of cases to transmit to ODO/FDU or PSC/DPB.
The Regional Office (RO) notifies Field Offices (FOs) when a State has a temporary
agreement with the Commissioner requiring the FO routing of disability cases directly
to ODO/FDU or PSC/DPB.
ODO/FDU or PSC/DPB keeps jurisdiction of the case until the case is transferred back
to the DDS.
This rule also applies to reconsideration and CDR actions on these cases and on other
cases as the agreement specifies.
For paper folders, send emergency clause cases to ODO/FDU or the PSC/DPB with a SSA-831 (Disability
Determination and Transmittal) with the following: "Emergency Clause case: (Name of
DDS)" in Item 11, Remarks.
For electronic folders, transfer the case through Electronic Disability Collect System (EDCS). The DPB/FDU
receipt the claim through the Modernized Integrated Disability Adjudicative System
(MIDAS) legacy system.
