DI 11020.001 Making a Childhood Disability Determination to Entitle Someone Else to a Different Benefit

Under P.L. 97-35 (the Omnibus Budget Reconciliation Act of 1981), a disability decision may be needed solely to:

  • Entitle a spouse, mother, or father caring for a child age 16-18 entitled to child's benefits; or

  • Pay the lump-sum death payment (LSDP) to a disabled widow(er) or a childhood disability beneficiary (CDB) when the spouse was not living with the deceased worker at the time of death.

In these situations, if the child-in-care provision is an issue, a disability determination for a child as young as age 15 years 6 months may be needed.

For details about Title II situations requiring a disability determination for a child to entitle another person for a different type of benefit, see DI 11025.001 Introduction to Disability Determinations for Entitlement to a Non-Disability Payment.

For the general requirements for CDB entitlement, see DI 10115.001.
