DI 11050.005 Categories of Railroad (RR) Related Claims

This section addresses the following categories of RR claims.

A. Career RR Worker

An employee is considered career RR if he or she meets the requirements for entitlement and eligibility for RR annuity. A career RR case is a Title II, Title XVI, or Title II/Title XVI claim filed by, or on behalf of, a RR worker who has at least 120 months (or at least 60 months after December 31, 1995) of RR service, or has been awarded a retirement or disability annuity under the Railroad Retirement Act (RRA).

NOTE: Refer to the Railroad Earnings Data (DRRE) screen in MCS EC (see MSOM MCSEC 001.020) or the ALERT and COMPUTATIONAL YEARLY EARNINGS data blocks in Information/Certified Earnings Records System (ICERS) to determine career RR worker status. (See SM 00349.045 and SM 00349.125).

B. Non-Vested RR Worker

A non-vested employee has less than 120 months (and less than 60 months after December 31, 1995) of RR service at time of adjudication.

C. Surviving Dependent RR Annuitant

A Childhood Disability Beneficiary (CDB) or Disabled Widow Beneficiary (DWB) is a claimant who is receiving, or has filed for, a RR annuity based on the deceased RR worker's RR earnings.

A CDB of a RR worker could be filing for:

  • CDB on the deceased RR worker’s record,

  • CDB on another parent’s record, or

  • Disability Insurance Benefits (DIB) on their own record.

A DWB of a RR worker could be filing for:

  • DWB benefits on the deceased RR worker’s record,

  • DWB on another prior spouse’s record, or

  • DIB on their own record.

D. Auxiliary Dependent RR Annuitant

A CDB of a living RR worker who is or becomes entitled to a DIB or RIB with SSA.

A CDB of RR worker could be filing for:

  • CDB benefits on the living RR worker’s record,

  • CDB on another parent’s record, or

  • DIB on their own record.

An Auxiliary Spouse (AUXSPO) of living RR worker. In this case, he or she could be receiving an annuity due to age (62-65) or based on having a child in care. See Life Claims Under the Railroad Retirement Act RS 01601.120C. for information on spouse annuity.

An AUXSPO of living RR worker could be filing for:

  • DIB on their own earnings record or,

  • DWB on a prior spouse’s record (in rare situations).
