DI 13005.115 Field Office (FO) Procedures When the Disability Determination Services (DDS) Finds Undocumented Work Activity and a Continuance is Not Possible in Medical Improvement Not Expected (MINE) or MINE-Equivalent Cases

A. Procedure for (MINE) and MINE-equivalent cases with undocumented work activity

For these cases, the DDS will send the medical folder to the FO and the FO will follow normal procedures to develop for work activity according to DI 13010.025. If the FO determines that benefits should continue despite work activity (for example, there have been less than nine worked trial work service months) establishment Section 1619 eligibility, or process extended period of eligibility (EPE), see DI 13010.025 and return the folder to the DDS for a medical review.

B. Procedure for MINE and MINE-equivalent cases when a continuance is not possible based on evidence in the medical folder

If the DDS cannot prepare a continuance based on the evidence of record and information obtained during the MINE process (for example, the individual indicates he or she has had a kidney transplant, or corrective heart surgery, etc.), the DDS will request the FO to establish personal contact. Even though the DDS uses routine continuing disability review (CDR) procedures, these cases require skillful interviewing and the DDS will forward the folder to the FO to request any action(s) to assist in making a medical decision.
