DI 23020.015 Presumptive Disability or Blindness and Emergency Advance Payment - Title XVI Only
While all Title XVI claimants must establish financial need based on the income and
resource requirements, certain initial Title XVI disability cases may meet special
criteria for receipt of payments in advance of the formal medical determination by
the Disability Determination Services (DDS). The Field Office (FO) is authorized to
make presumptive disability (PD) or presumptive blindness (PB) determinations in 11
special impairment categories. The DDS can make such determinations in any case with
a high probability of allowance. Claimants may receive up to 6 months of payments
based on PD or PB prior to the formal DDS determination. These cases should be processed
according to (DI 23525.001, DI 11055.230, DI 11055.231, and DI 11055.240). In addition, certain Title XVI claimants may also qualify for a one-time emergency
advance payment (EAP). Only the FO can issue an EAP.
The FO will identify these cases by flagging the EDCS case, or by using Form SSA-408
(Route Slip) and annotating “Expedite-Delayed Case Flag” for EDCS exclusions. To identify
disability cases which meet the nondisability advance payment criteria but in which
the FO is unable to make a PD or PB determination, the FO will add a message in eView.
For non-EDCS cases, use Form SSA-408 and annotate “PD (or PB) Needed for AP”. The
FO will determine which cases warrant flagging by using specified guides to determine
