DI 28075.300 Disability Determination Services (DDS) Procedure to Vacate a Continuing Disability Review (CDR) Medical Cessation Determination

A. Introduction to vacating a cessation determination

There are times when the Disability Determination Services (DDS) makes a Continuing Disability Review (CDR) medical cessation determination, but the FO should never have initiated the CDR. For example, the DDS completes a CDR on a case that should have been protected from a medical review because a Ticket to Work was assigned and in use, or the State Vocational Rehabilitation (SVR) program was in use before the CDR was initiated. When this situation occurs, DDS must vacate the cessation determination to restore the case to its prior status.

B. Procedure for vacating a medical cessation determination on an electronic CDR (eCDR)

If a CDR is currently pending at the DDS, and the case meets screen out criteria, close the case in the National Disability Determination Services System (NDDSS) as a “No Determination -- No CDR Issue” as follows:

  1. 1. 

    Receipt the CDR as a reactivation.

  2. 2. 

    Document the certified electronic folder (CEF) by adding an SSA-5002, (Report of Contact) that contains the following language:

    “Inappropriate medical CDR cessation determination was initiated or processed. The disabled person had CDR protection based on their _________ (example: Ticket to Work) status. Do not use any documentation contained in this file related to this CDR. Do not consider any medical evidence in file obtained for this CDR for future CDR or claim purposes.”

  3. 3. 

    In the “Notes” column in eView, annotate any documents created, received, or used for the eCDR with the remark “Do not use – CDR vacated.”

  4. 4. 

    Prepare and send the notice of the vacated medical cessation determination to the disabled person (see exhibit in DI 28075.310).

  5. 5. 

    Close the case in the National Disability Determination Services System (NDDSS) as a “No Determination -- No CDR Issue.”

  6. 6. 

    Transfer jurisdiction of the eCDR CEF and paper CPD folder, if applicable, to the FO.

C. Procedure for vacating a medical cessation determination on a paper folder CDR

If you have a paper folder:

  1. 1. 

    Receipt the case as a reopening.

  2. 2. 

    Document the folder by adding an SSA-5002 containing the following language:

    “Inappropriate medical CDR cessation determination was initiated or processed. The disabled person had CDR protection based on their _________ (example: Ticket to Work) status. Do not use any documentation contained in this file related to this CDR. Do not consider any medical evidence in file obtained for this CDR for future CDR purposes.”

  3. 3. 

    Annotate the Form(s) SSA-832/833: “DO NOT PROCESS – CDR vacated.”

  4. 4. 

    Prepare and send the notice of the vacated medical cessation determination to the disabled person. See exhibit in DI 28075.310 to be consistent with the information in electronic processes. Include a copy of the notice in the paper folder.

  5. 5. 

    Close the case in NDDSS as a “No Determination -- No CDR Issue.”

  6. 6. 

    Transfer jurisdiction of the CDR to the FO.
