DI 81010.145 Processing Reconsideration Requests of Field Office (FO) Determinations

A. Electronic Disability Collect System (EDCS)

If the technically denied disability claim was previously established on EDCS, see Processing Field Office (FO) Technical Reactivations - DI 81010.110 for Certified Electronic Folder (CEF) cases to determine whether the reestablished disability claim being sent to the Disability Determination Service (DDS) can be processed by reactivating the prior EDCS record.

If the case cannot be processed as an EDCS reactivation, it must be processed as an EDCS exclusion per CEF Exclusions and Limitations - DI 81010.030C.

NOTE: If an EDCS record was established for a technically denied claim, that EDCS record MUST be closed following instructions in Creating EDCS Cases - DI 81010.020D.3. and Deleting and Manually Clearing EDCS Cases - DI 81010.105.

NOTE: Do not attempt to use an open EDCS record for a technically denied claim to send a reconsideration action to the DDS.

B. Title II Claims MCS Processing

1. Reconsideration on MCS

If a Failure to Cooperate (FTC)/SGA/technical denial is affirmed, process the unfavorable reconsideration decision through MCS;

If a FTC/SGA/technical appeal denial is reversed, do NOT establish a reconsideration segment on MCS. Instead, document the special determination and send the interim notice described in Processing a Reconsideration Request of an Initial Denial Based on Non-medical Issues - DI 12005.010 in the reestablished MCS claim per Processing Reconsideration Request of FO Determinations - DI 81010.145B.2.

NOTE: When a claimant, denied for failure to cooperate, later submits the requested development, e.g., signed SSA-827s, within the appeal period, treat it as an implied request for reconsideration.

2. Reestablish the initial disability claim on MCS

The previously denied initial disability claim has to be reestablished on MCS. Create a new segment on MCS, using the original application/protective filing date, before sending the claim to DDS for a disability determination. The application receipt date is the date the FO received the request for reconsideration or implied request for reconsideration. The material file date (MFD) should be the same as the application receipt date. Enter the FDC of C on the DECI screen for (MI) purposes. The FDC code of C will exclude the time, from the original application date through the new application receipt date on the new DW01, from FO1 time. However, the time will not be excluded from the mean overall time on the case.

C. Title XVI Claims -- MSSICS Processing

Do not use the language in Procedure When a Nondisability Denial Is Reversed SI 00603.011B.2., that says For a reopening that can be processed on MSSICS, choose DENIED CLAIM REOPENING from the SSI Menu (MSSI) and complete the full path. Use the following instructions.

When a claim has been denied by the FO for failure to cooperate (N18) or another non-medical reason (N01, N04, etc.), and the denial is reversed based on an actual or implied reconsideration request, document the file with the special determination and the interim notice described in Processing a Reconsideration Request of an Initial Denial Based on Non-medical Issues - DI 12005.010.

NOTE: When a claimant, denied for failure to cooperate, later submits the requested development, e.g., signed SSA-827s, within the appeal period, treat it as an implied request for reconsideration.

If a DDS medical decision is required, you will have to update the existing denied claim with the appropriate appeal information, and establish a new MSSICS claim.

1. DAY 1

Open an appeal event to record the appeal information, and complete these screens with the following information:

  • ACAD - Enter an appeal level of RECONSIDERATION.

  • AISS Choose the appropriate appeal issue. For an N18 denial, enter an appeal issue of OTHER, and type in N18 next to EXPLAIN.

  • AJAS Leave the APPEAL STATUS as 1' PENDING IN APPEAL CONTROLLING OFFICE.

  • Consolidated Claims Experience (CCE) Development Worksheet - Enter a receipt date for the RECON REQ issue.

  • AJAS - After receipting in the RECON REQ issue on the CCE Development Worksheet, complete the APPEAL STATUS with '5' - DECISION EFFECTUATED.

  • ADIS - Enter DECISION TYPE as '1' - FULLY FAVORABLE, and enter the date of the interim notice in FULLY OR PARTIALLY FAVORABLE EFFECTUATION NOTICE DATE.

  • Build the SSR. The establishment of the APPE segment on the denied SSR will provide work credit for processing the SSI reconsideration, and the presence of the EFT date will prevent the appeal from pending on the WMI Appeals List.

2. DAY 2

Input a MANUAL CLEARANCE (2/12) to the denied record.

REMINDER: Day two will be Tuesday after a weekend, or the second workday after a holiday.)

Establish a new claim in MSSICS using the same application date. You may propagate the information from the MSSICS pending file that you just MANCLRd. Be sure to annotate REOPENED PRIOR CLAIM on CMSC to exclude the record from statistics. When you build the SSR, MSSICS will terminate the denied record and establish a new SSR in PSY:H80, unless you do full development and adjudicate the claim to pay.

By following the steps shown above, you will establish a new claim that will be controlled on the SSI WMI I/C PENDING list, and in the event the claim is allowed, most notices will be automated by the system. Your office will also receive work credit for an SSI RECONSIDERATION when you build the APPE segment to the prior SSR.
