See regional POMS instructions for specific State plan limits. Limits that are specific to an eligibility category (e.g., aged) refer to the recipient's status at the time of conversion.

1. a. 

   If a converted recipient's resources exceed both the SSI limit on resources and the limit for the State of conversion, and the recipient disagrees with the field office's determination based on its interpretation of the State plan provisions, refer the question by memorandum to the Assistant Regional Commissioner, Program Operations and Systems. The Regional Office develops and coordinates with the State to determine the recipient's status and allowable resources according to the State plan in effect in October 1972.

2. b. 

   In referring the case, forward copies of all pertinent documents with the memorandum explaining the issue.

3. c. 

   Consider whether or not disposition of nonliquid resources is appropriate, and process accordingly (SI 01150.200 ff.).

4. d. 

   Advise the recipient of the delay in making a determination.

5. e. 

   Diary the case for 30 days, and follow up with the Regional Office, if necessary, by telephone or mail.
