GN 02215.001 Overpayment Notice Modifications - Debtor Outside U.S.

A. Policy

When a debtor from whom recovery is sought is outside the U.S., jurisdiction for the initial overpayment determination and notice may or may not be the Division of International Operations (DIO). See GN 02215.010.

Regardless of the PSC having jurisdiction, certain changes in the preparation and delivery of the overpayment notice are necessary. When a MADCAP system notice is not used for a debtor outside the U.S., an overpayment notice must be prepared using exhibit notices in NL 00703.000.

B. Procedure-Notice

Send all overpayment notices by direct mail to the person from whom recovery is sought with the following exceptions:

1. GREECE

If adjustment is proposed:

    Send copy of notice via Form OF-41 to:

  2. b. 

    Annotate Form OF-41, “For Your Information.”

If refund is the sole means of recovery, see 8. below.

2. PHILIPPINES

If refund is the sole means of recovery:

  1. a. 

    Send original and one copy of notice via OF-41 to:

    Annotate OF-41, “For Transmission to Addressee.”

NOTE: The American Embassy will add a footnote explaining the equivalent amount in pesos (at the current exchange rate) to be refunded before mailing the notice to (or personally contacting) the debtor.

Send any overpayment notice via Form OF-41 to:

If refund is the sole method of recovery:

    Send the overpayment notice directly to the (GN 00904.225) debtor.

  2. b. 

    Send a copy (via Form OF-41) to the FBU, with a copy of Form SSA-3560, Instructions Regarding Overpayments of Social Security Benefits.

The FBU, based on workload and/or clientele, will determine the appropriate followup contact.
