HA 01105.002 Organization of HALLEX

A. Chapters and Subchapters

The Hearings, Appeals and Litigation Law (HALLEX) manual consists of seven chapters:

  • HA 011 - General Subjects

  • HA 012 - Administrative Law Judge Hearings

  • HA 013 - Appeals Council Review

  • HA 014 - Civil Actions

  • HA 015 - Temporary Instructions (TI) - This chapter contains instructions that: apply only for a limited time; address special situations; or communicate information that will be later incorporated into HAs 011 through 014. When appropriate, a TI has an expiration date to indicate when the instruction will no longer be effective. TIs are topically divided into the following subchapters:

    • HA 01505 - Introduction to the Temporary Instructions

    • HA 01510 - General Subjects

    • HA 01530 - Disability Matters

    • HA 01540 - Court Cases

    • HA 01560 - Redeterminations Under Sections 205(u) and 1631(e)(7) of the Social Security Act

  • HA 024 - Preambles to Selected Regulations — This part contains preambles to selected regulations having significant impact on the Office of Hearings Operations (OHO) or the Office of Appellate Operations (OAO) prior to 1994. Because preamble information contained in final rules published in the Federal Register, beginning with Volume 59 (1994), is available through the internet from the Government Publishing Office, no further transmittals will be issued in HA 024.

  • HA 025 - Appeals Council Interpretations (ACI) — ACIs are designed to identify and resolve issues arising from gaps in policy or unclear statements of policy, promote greater consistency and uniformity in applying policy throughout the adjudicatory process, and establish precedents at the hearings and appeals levels of adjudication.

B. Numbering System

“HALLEX HA” identifies the policy as part of the Hearings, Appeals and Litigation Law manual. Following “HALLEX HA”:

  • The first three digits identify the chapter.

  • The fourth and fifth digits identify the subchapter.

  • The remaining digits after the decimal point identify the section number.

Example:

HALLEX HA 01120.007 is Chapter 011, Subchapter 20, Section 7.

The same numbering system is used for the TIs in HA 015. TIs are numbered sequentially within the subchapter.
