DI 12586.075 Effectuating Payment Actions -- Favorable Title II -- Stieberger Cases

A. Policy

Payment is made for the PAYMENT PERIOD according to DI 12586.045. The class member will continue to be paid for months after the end of the PAYMENT PERIOD, provided the regular factors of entitlement are met and all appropriate deductions and offsets are applied.

Class members who are currently on the rolls as RIB or DIB beneficiaries are entitled to a DIB recomputation if the Stieberger period of disability results in a higher MBA.

B. Procedure

1. Systems

Claims are DOFA non-CAPS.

  1. a. 

    Send title II awards to the PSCs as Awards Processing Operations (APO) processing exclusions via Manual Adjustment Credit and Award Processing (MADCAP).

  2. b. 

    Follow normal procedures for processing cases awarded at the ALJ or AC level.

2. Compute Benefits

When computing benefits, consider the following:

  1. a. 

    Medicare premiums - Consider state buy-in provisions. If it appears that the claimant will be liable for over 6 months retroactive Medicare premiums, initiate equitable relief development. Do not delay adjudication pending resolution of the equitable relief issue. If the issue is still pending when the claim is forwarded to the processing center, indicate that fact on the SSA-3601.

  2. b. 

    Overpayments - apply normal rules.

  3. c. 

    Attorney fees - apply normal attorney fee withholding rules.

  4. d. 

    Offsets - apply normal rules.

  5. e. 

    Payment rules for DAA cases apply.

3. Prepare Award

To process an award:

  1. a. 

    Prepare SSA-101-U3 for PC processing.

    • •

      Show “ Stieberger ” in item 11 (or if applicable, follow regional instructions for MCS processing).

    • •

      Show Stieberger onset date in “DOD/DOO” field.

    • •

      Show the original application date.

    • •

      Show first month of the Stieberger PAYMENT PERIOD in the “ENT. DATE” field of item 6.

  2. b. 

    Route case to PSC under cover of SSA-3601. Check "Other" block and indicate in “Remarks” that “Case should be processed per DI 42586.001 ff.”

4. Systems Annotation

If any of the exceptions to normal entitlement rules in DI 12586.055 apply, the Special Message field of the MBR must be annotated to show “Special Stieberger rules used.”
