DI 27540.020 Concurrent Title II/Title XVI Reopening Notices
In adverse reopening determinations in concurrent Title II/Title XVI claims, the due
process requirements applicable to Title XVI also apply to the Title II claim. These
cases require due process decision notices with benefit continuation language, where
applicable, or Goldberg/Kelly language. Benefit continuation, as provided under the
Social Security Act (as amended by P.L. 98-460), requires the claimant to request
benefit continuation. Goldberg/Kelly provisions automatically continue benefits when
the claimant appeals within 10 days.
Prepare notices for
