DI 29501.020 Returning Requested Development to the Administrative Law Judge

When an administrative law judge (ALJ) makes an assistance request, the ALJ retains jurisdiction of the case and makes the final decision. The disability determination services (DDS) takes the following actions after obtaining the requested information.

A. Electronic processing

The DDS actions for processing electronic or paper assistance requests are similar; however, in electronic processing, after adding the new evidence to the file, there is no need to forward paper copies of any form or request to the ALJ since the information is transmitted to the electronic folder. Enter the completed development, reports, or forms into the electronic folder.

B. Paper cases only

For paper cases:

  • Forward the completed development, reports, or forms to the requesting ALJ.

  • If the requested development was a consultative exam (CE), attach a copy of the appointment letter or DDS authorization form to the medical report forwarded to the ALJ.

  • Annotate the routing form with “Administrative Law Judge's Direct Request” in the remarks section.

C. Clearance and reporting

After the requested development is completed:

  • Clear DDS controls.

  • Report hearing case development as though medical evidence requests and CEs had been authorized on the DDS's own initiative.
