SI 02003.006 Effective Life of an IAR Authorization

Reimbursement is payable to a State only during the effective life of an IAR authorization.

A. Policy for the effective life of an IAR authorization: initial claims

1. Effective life beginning date

The effective life of an interim assistance reimbursement (IAR) authorization for an initial claim begins with the date:

  • we receive the signed paper authorization form from a manual notification State; or

  • an automated notification State notifies SSA using its electronic process that it has received a signed authorization from an individual. NOTE: Automated States transmit the Grant Reimbursement (GR) code to SSA along with the date the individual signed the authorization via an electronic interface.

2. Effective life ending date

The effective life of an IAR authorization for an initial claim ends 12 months from the date of receipt by SSA if the individual does not apply for Supplemental Security Income (SSI) within the 12-month period.

If one of the following events occurs before the end of the 12 months, the authorization effective life ends as of the date:

  • SSA begins making recurring monthly SSI payments;

  • we make a final determination on the individual's claim for SSI benefits and the individual does not make a timely request for review; or

  • the individual and the State agree to terminate the authorization.

3. Effective life extended beyond 12 months

The effective life of an IAR authorization extends beyond 12 months if the IAR applicant applies for SSI on or before the date we receive the authorization, or the applicant applies for SSI within 12 months of the beginning date. In these situations, the life of the authorization extends until one of the following happens:

  • we make the first payment of retroactive SSI benefits on the individual’s application;

  • we make a final determination on the claim for SSI benefits and the individual does not make a timely request for review; or

  • The individual and the State agree to terminate the authorization.

B. Policy for the effective life of an IAR authorization: posteligibility (PE) cases

1. Effective life beginning date

The effective life of an IAR authorization for a PE case begins with the date:

  • we receive the signed paper authorization from a manual State; or

  • an automated State notifies us it has received a signed authorization from an individual.

2. Effective life ending date

The effective life of an IAR authorization for a PE case ends 12 months from the date of receipt by SSA if the individual does not apply for SSI within the 12-month period.

If one of the following events occurs before the end of the 12 months, the authorization effective life ends as of the date:

  • SSA makes the first retroactive PE payment of SSI benefits following the suspension or termination of the individual's benefits;

  • SSA makes a final determination on the individual's request for reinstatement of SSI benefits and the individual does not make a timely request for review; or

  • The individual and the State agree to terminate the authorization.

3. Effective life extended beyond 12 months

If the IAR applicant applies for SSI reinstatement on or before the date of receipt of the IAR authorization or within 12 months of receipt, the life of the authorization extends beyond 12 months. The effective life of the authorization extends until one of the following happens:

  • SSA makes the first payment of retroactive SSI benefits on the individual’s PE request for review;

  • SSA makes a final determination on the claim for SSI benefits and the individual does not make a timely request for review; or

  • The individual and the State agree to terminate the authorization.

C. Policy for 30 calendar day deadline for sending IAR authorization to SSA

An IAR authorization is not binding on the individual unless the State notifies SSA of receipt of the authorization within 30 calendar days. If the State does not meet the deadline, SSA will pay the recipient the retroactive SSI payments according to SSI priority of payment rules. The State can choose to ask the recipient for the money due the State, but SSA will not assist the State with its request to the recipient.

For initial claims and posteligibility cases, an IAR authorization is invalid and has no effective life if:

  • a manual notification State fails to notify SSA within 30 calendar days of the date the individual signed the authorization;

  • an automated notification State fails to notify SSA within 30 calendar days of the date the State matches the applicant’s record on the State’s general assistance file with a pending SSI record.

NOTE: If the authorization is invalid because the State takes longer than 30 days to notify SSA, treat the authorization as a protective filing. This protection prevents an individual from losing benefits because of a State processing deficiency.
