Act on any compromise offer from an overpaid individual or their representative to
settle an overpayment. For guidance on when we have the authority to compromise an
overpayment, refer to GN
02215.100B.
We usually accept a compromise offer of at least 80 percent of the overpayment amount
because it would not be cost effective to expend limited agency resources to pursue
recovery of the full overpayment amount by enforced collections. We have found that,
on average, we do not collect the full overpayment amount by recovery and adjustment.
Accepting a compromise offer of 80 percent ensures we fulfill stewardship obligations
while also allowing SSA to efficiently recover overpayments.
We may accept offers below 80 percent when the amount offered is justified by the
individuals financial circumstances. Refer to SI 02220.031C.

When to develop financial circumstances
Develop financial circumstances when:

The debt is $5,000 or less but the offer is less than 80 percent of the debt amount,

02220.031C. Document financial development and ability to refund the overpayment on a Report
of Contact. When financial information is needed, obtain the information from the
debtor in accordance with SI 02220.026.
Resolve any discrepancies in the individual's finances. For example, if financial
information from the debtor indicates expenses exceed income and there are no cash
assets, yet the debtor offers to compromise a $4,500 debt by repaying $2,000, the
debtor should explain how they will get the money to make the compromise payment.
