NL 00705.080 Model Letter Notifying Claimant Earnings Test Not Met On Or After Date Of Onset
(use special insured status definition under the 1967 amendments when appropriate).
This refers to your application under the disability provisions of the Social Security
Act.
One of the requirements of the law is that a person must have social security credits
in 20 calendar quarters (5 years) during a 10-year period ending on or after the date
on which he became disabled. According to our records, you have social security credits during the 10-year period before you stated you became disabled.
Unless you can submit evidence that your disability began earlier than you previously
stated, or that you had additional earnings which would enable you to meet the earnings
requirements at or after the date you stated you became disabled, it appears that
your application will be disallowed. If you submit evidence that your disability began
at an earlier date, or that you had additional unrecorded earnings, we will again
check to see if you meet the earnings requirement as of that date.
Even though your disability application may be disallowed, it will not be a determination
as to the payment of other social security benefits. Thus, retirement benefits to
your family in the event of your death if the necessary requirements for these benefits
are met.
If we do not hear from you within 10 days form the date of this letter, we will assume
that you have no additional evidence to submit. If you have any questions, please
consult the district office shown above. If you call in person, please give this notice
to the district office representative.
