      - 
         
            A. 
            
               Child or father acquires status of child or parent if:
               
               
                  - 
                     
                        1. 
                        
                           parents intermarry and father recognizes child; or
                           
                         
                      
                   
                  - 
                     
                        2. 
                        
                           effective 08/14/77, the child is declared legitimated by the superior court of the
                              county in which the father resides; or
                           
                           
                         
                      
                   
                  - 
                     
                        3. 
                        
                           (I) effective 06/10/83:
                           
                           
                              - 
                                 
                                    a. 
                                    
                                       parents intermarry after the birth of the child; or
                                       
                                     
                                  
                               
                              - 
                                 
                                    b. 
                                    
                                       acknowledgment of paternity or legitimation by the father exists; or
                                       
                                     
                                  
                               
                              - 
                                 
                                    c. 
                                    
                                       a court decree adjudges the decedent to be the father before his death; or
                                       
                                     
                                  
                               
                              - 
                                 
                                    d. 
                                    
                                       paternity is established after the father's death by clear and convincing evidence.
                                       
                                     
                                  
                               
                           
                           
                         
                      
                   
               
               
             
          
       
      - 
         
            B. 
            
               If a claim arises involving the legitimacy or inheritance rights of an individual
                  who appears to be the child of a surrogate arrangement, and you cannot resolve the
                  issue under current POMS instructions, submit the case to the Office of the General
                  Counsel (OGC) per GN 01010.815 ff.
