GN 00904.300 SSI applications for individuals who move to Puerto Rico or the U.S. Virgin islands

A. Introduction

Because there is no SSI eligibility in Puerto Rico or the U.S. Virgin Islands, the Field Office (FO) staffs there are generally unfamiliar with the SSI program requirements.

B. Policy

For claims in which the SSI applicant moves to Puerto Rico or the U.S. Virgin Islands, the mainland SSA FO with jurisdiction of the applicant/recipient's last known address in the U.S. prior to their move to Puerto Rico or the U.S. Virgin Islands will retain jurisdiction of the claim until it is paid or denied. (See DI 11010.265 and DI 20101.035E.)

Note: The Puerto Rico and U.S. Virgin Island FO's will still be responsible for such postentitlement items as overpayments, nonreceipt, etc.

C. Process

The FO's retaining jurisdiction will prepare Form SSA-562-U3 (Request for Assistance) to the local office in Puerto Rico or the U.S. Virgin Islands in order to secure any outstanding development.

D. Procedure

1. Requesting office

Use the following instructions to complete Form HA-562-U3.

  • indicate the period(s) involved;

  • specify income, resource, and living arrangement/State supplementation issues and the types of verification required, and

  • send all necessary forms and instructions for completion with Form SSA-562-U3.

Reminder: The name, area code, and telephone number of the requesting office contact person should be included for any questions that may arise.

  • notify the Office of Analytics, Review, and Oversight (OARO) to route favorable SSI ALJ decisions, where the claimant is now residing in Puerto Rico or the Virgin Islands, to the mainland FO of last jurisdiction.

Note: This will save time in transferring the case from one office to the other and should result in speedier effectuation of the cases.

2. Assisting office

Send a progress report to the requesting FO if the development will take more than 20 days.

Note: This procedure would be in line with the usual requests for assistance. This would eliminate unnecessary followups by the requesting office.

3. Followups

Send all followups after thirty days to:
