GN 01726.315 Earnings Records for Spouses/Partners or Widow(er)s - Netherlands Agreement

A. Background

To determine the amount of their spouse's or partner's supplement or the amount of their widow(er)'s benefits, the SVB requires a copy of the spouse's, partner's or widow(er)'s own earnings record. This presents no problem with widow(er)'s claims or when a spouse files a claim in his/her own right because his/her application permits disclosure of the earnings under the “routine use” provisions. However, when the insured person might be eligible for a spouse's or a partner's supplement and the spouse has not filed an application, his/her consent to release earnings information is required.

B. Procedure

Follow the procedure below which describes the actions needed to provide a widow's, spouse's or partner's earnings record for the SVB.

IF.. THEN. ..
A widow(er) files for Dutch survivor's benefits under the agreement Obtain a totalization earnings record on the widow(er)'s own SSN and include it in the claims package.
A claimant for Dutch old-age benefits indicates that he/she has a spouse or shares a household with a partner Obtain the spouse's or partner's consent to release the earnings record to Dutch agency. Diary 30 days for a response. When the consent is received, obtain the spouse's or partner's totalization earnings record and include it in the claims package. Retain the consent statement in file.EXCEPTION: A spouse's consent to release his/her earnings information is not necessary if the spouse has filed for U.S. benefits under the Dutch agreement.
