We are writing about your request that we reconsider your Social Security overpayment. Based on the facts we have, our decision that you are overpaid is correct. We have explained our decision in the enclosed Form SSA-662.

You also requested that we waive the collection of your overpayment of $     (1)    . Based on the facts we have now, we cannot approve your request.

Before we decide if you have to pay back the overpayment, you have a right to meet with us to review your file and to have a personal conference. A person who has not made any decision about your overpayment or waiver request will meet with you at the personal conference. Someone from the Social Security office most convenient to you will write to you to schedule these appointments.

 

What Happens At a Personal Conference

 

At the personal conference, you will meet with the person who will decide your waiver request. You can tell this person why you think you should not have to pay us back. At the meeting you can also do the following things.

  • You can have a lawyer, friend or someone else help you with your case.

  • You can bring other people to help explain your case.

  • You can review your file again, and add any new facts you have.

  • You can question the facts we have and the people who gave them.

After the personal conference, we will send you a decision on your request for waiver. We will tell you what you need to do if you think we are wrong about our decision on your waiver or our decision that you are overpaid.
