GN 02603.075 Facility of Payment Provision

A. Introduction to the facility of payment provision

The facility of payment provision allows a modified payment method for individuals living in the same household with an auxiliary or survivor beneficiary who is subject to a deduction.

B. Dates of application

1. For benefits payable for months prior to 01/1996

  • If the deduction before reduction provision causes no change in the total benefit amount payable to the household, do not make the deduction.

  • If the deduction causes a change in the total payable amount to the household, the deduction should be no less than the reduced amount payable to the household.

  • Do not pay any resultant increase in the benefits to auxiliaries and survivors who are not subject to the deduction. Instead, pay it to the beneficiary subject to the deduction.

  • This payment to the beneficiary subject to the deduction is facility of payment provision.

  • The facility of payment provision applies to all of the deduction before reduction events listed in GN 02603.040 except the suspension of auxiliary or survivor benefits because of noncompliance with the drug addiction and alcoholism (DA&A) treatment provisions of P.L. 103-296 and the prisoner suspension provisions.

2. Separate households

In applying the facility of payment provision, beneficiaries who do not live in the same household with the beneficiary subject to a deduction receive the readjusted rate. However, delay payment of the readjusted rate resulting from work suspension or temporary work deductions under the annual earnings test until after receipt of the annual report of earnings and the deductions become permanent.

3. For Months after 12/1995

After 12/1995, the facility of payment provision no longer applies.
