C. DEVELOPMENT

In addition to the development and documentation needed according to the instructions in GN 02608.104 for meeting a specific 1977 entitlement factor, evidence of pension eligibility before December 1982 must be obtained from the employer or pension paying agency. The evidence may be obtained via mail or telephone. SSA cannot make a decision on behalf of the agency as to whether a person meets the agency's eligibility criteria.

The following outlines of the teacher's retirement systems for each State in the Dallas Region provide general background information for determining if the exemption may apply.

1. Arkansas

All school systems were covered by Social Security in December 1982. Acceptable evidence of the exemption due to the last day of employment being covered under Social Security is outlined in GN 02608.102.

2. Louisiana

The basic requirements to qualify for a teacher's retirement system pension before December 1, 1982 were:

  • Age 60 and at least 10 years of creditable service; or

  • Any age and at least 20 years of creditable service.

If the claimant is unable to provide evidence of pension eligibility before December 1982, the claimant or FO may send a request with written authorization to:

3. New Mexico

Most school district employees may meet the exemption due to the last day of employment being covered under Social Security. See GN 02608.102 for documentation requirements. If evidence of pension eligibility before December 1982 is needed, the claimant may contact the agency direct at the address below. The claimant should indicate if any other State government work is involved since this could result in an earlier eligibility date. The FO may also send a request with written authorization to the Santa Fe District Office for assistance.

4. Oklahoma

The basic requirements to qualify for a teacher's retirement system pension before December 1, 1982 were:

  • Age 55 with 10 years of service; or

  • Any age with at least 30 years of service.
