GN 02608.106 Exemption Due to Pension Eligibility In November 1982 or June 1983

A. Eligible for pension in November 1982

GPO does not apply to benefits payable for December 1984 or later if the spouse:

  • was eligible for the government pension in November 1982, however the benefit payment was delayed for that month until the following month, and

  • meets either the 1977 entitlement requirements (i.e., the 20-year duration of marriage for women; or the one-half support test for men)

B. Eligible for pension in June 1983

GPO does not apply to benefits payable for December 1984 or later if the spouse:

  • was eligible for the government pension in June 1983, however the benefit payment was delayed for that month until the following month,

and

  • meets the 1983 one-half support requirement (both men and women).

C. Proofs for exemption

Obtain the following documentation before applying the exemption:

1. For a pension in November 1982

  • evidence that the spouse met the 1977 entitlement requirements (i.e., the 20-year duration of marriage for; or the one-half support test for men); and

  • evidence of pension eligibility or entitlement in November 1982 from the employer or pension paying agency

2. For a pension in June 1983

  • evidence that the spouse met the one-half support requirement; and

  • evidence of pension eligibility or entitlement in June 1983 from the employer or pension paying agency.

You may use Civil Service Annuity (CSA) numbers as evidence of pension eligibility. For more information on CSA numbers, see GN 02608.100C.5.
