GN 03312.090 Ad Hoc Decisions to Disclose Information for Law Enforcement Purposes Unrelated
In certain cases involving law enforcement activities in which a disclosure is not
allowed under other disclosure regulations (e.g., matters of national security, health
and safety, terrorism, or for law enforcement activities directed by a presidential
Executive Order), the Commissioner has delegated the authority to the General Counsel
for the Social Security Administration to approve, on a case-by-case basis, the disclosure
of non-tax return information under the ad hoc disclosure provisions of the regulation,
20 C.F.R. §
401.195, if the Privacy Act (5 U.S.C. § 552a) and other Federal law would not prohibit disclosure.
The General Counsel has re-delegated this authority to the Deputy General Counsel(s)
and the Head of Privacy and Disclosure Policy (PDP). An ad hoc request must meet the
requirements discussed in GN 03316.140.
Refer these requests to PDP. Submit requests to ^OGC OPD
