GN 03345.020 Statements of Disagreement With SSA Records
Statements filed by individuals disagreeing with SSA's decison not to correct or amend his or her record will be:
Made part of the disputed record.
Photocopied and sent to any agency or person to whom SSA accountings show the record was disclosed.
Provided to anyone to whom the record is subsequently disclosed.
1. Disputed Paper Record
Handle disputed records that are part of a paper file (such as a claims file) as follows:
File copy of statement of disagreement in appropriate record.
Send copy of statement, disputed record, and letter of explanation to any agency or person to whom a copy of the record has previously been provided.
Include statement of disagreement when making future disclosures of the record.
2. Disputed Automated Record
Handle disputed automated records (such as the MBR) as follows:
Make statement of disagreement part of the supporting paper file (e.g., claims folder).
Annotate automated record to indicate it has been disputed.
