GN 03365.120 Requests for “Living or Dead” or other Personal Information about the Person Sought

Procedure

Requests received for “Living or Dead” information will be complied with if the SSN or identifying information (complete name, date and place of birth, and parents’ names, including mother’s maiden name) is provided in the following instances:

  • The request must not involve more than five individuals.

  • The request involves more than five individuals who are members of the same family.

A fee is not required to furnish this information.

However, if the request is from an individual or organization (governmental or private) and involves more than five individuals who are not members of the same family, i.e., for genealogical purposes, deny request, inform of the fee.

If an SSN or identifying information is furnished, obtain the required queries and respond using the Form SSA-L975 (GN 03365.135B).

NOTE: If the only source of the death information is the NUMIDENT which contains the notation "THIS RECORD CONTAINS STATEMENT OF DEATH INFORMATION WHICH SHOULD NOT BE DISCLOSED", do not disclose the death information. However, if death information is on the MBR, SSR, etc. disclosure can be made even though the NUMIDENT contains the notation.

If our records do not indicate that the individual is deceased, inform the inquirer that we have no records showing an indication of death and that our records are inconclusive in this respect, as we are not always notified of an individual’s death.

If our records indicate that the individual is deceased, furnish the inquirer with all the information requested. Return all correspondence with our response.
