GN 04060.060 Notice of Results of Reopening
When a determination or decision is reopened and revised under the rules specified
in the previous sections, notice of the revision including an explanation of the reason
for the revision and of the individual's appeal rights, is mailed to the party or
parties to the determination or decision, except as noted in GN 04060.065. However, if a determination or decision is reopened but not revised, the notice
does not include an appeal paragraph and is sent only if the reopening was at the
request of a party or if a notice of reopening had been previously sent.
When an HO, on his own motion, proposes to revise a decision on the basis of new and
material evidence, he notifies the party or parties and offers them an opportunity
to present evidence or arguments concerning the proposed revision either in writing
or at a hearing.
The right to reconsideration, review, or hearing applies to the entire determination,
not just the part revised.
