GN 04442.220 Reviewing the Results of Corrective Action

A. Introduction

After the DRS has obtained any additional evidence because of a documentation deficiency, the claim must be returned to the review component before effectuation.

B. Procedure

1. DQB AGREES WITH CORRECTIVE ACTION

The DQB must:

  1. a. 

    Prepare a Federal Review Results Form.

  2. b. 

    Return claim to DRS for effectuation.

NOTE: Do not remove the Sample Flag.

2. DQB DISAGREES WITH CORRECTIVE ACTION, DETERMINATION STILL DEFICIENT

If the disagreement involves the adequacy or interpretation of medical evidence:

  1. a. 

    Send the claim to RMCS on an SSA-448 for comments.

  2. b. 

    When RMCS returns the claim, decide if you agree or disagree with the DRS determination.

    • Agreement: Send the claim to the DRS for effectuation.

    • Disagreement: Explain your disagreement on another SSA-1774-U5 marked “Second Return” and return the claim to the DRS to correct the deficiency.
