RS 00301.600 Election of Coverage by Vow-of-Poverty Order

A. Introduction to election of coverage by vow-of-poverty order

The election of coverage by a religious order under the “vow-of-poverty provision” may give a member of the order insured status.

B. Procedure for election of coverage by vow-of-poverty order

  1. 1. 

    Not previously insured - no prior application

    Apply the normal retroactive period of six months to the date of filing of the application, written inquiry, or statement of the intent to file.

  2. 2. 

    Not previously insured — prior application

    If the rules of administrative finality permit reopening a previous determination, use the date of application and the date the wage earner (WE) acquired insured status to determine the month of entitlement.

  3. 3. 

    Fully insured prior application

    The WE may be eligible for a recalculation or re-computation because of the additional coverage. If the rules of administrative finality permit reopening the determination under the previous application (e.g., within 4 years), pay a retroactive increased benefit. If not, the increase in benefits will be payable prospectively only.
