RS 00615.702 Use of the DRC in Computing Widow(er)'s Benefits

A. BACKGROUND

The 1977 amendments provide an alternate method for computing the widow(er)'s original benefit, to include the DNH's DRCs.

B. POLICY

1. Eligibility

The DRCs will be added to the widow(er) benefit if:

  • NH was entitled to RIB and MBA was increased by DRCs or

  • NH would have been entitled to RIB and MBA would have been increased by DRCs.

NOTE: Entitlement to a benefit from the Railroad Board is not entitlement under the meaning of this section. DRCs can apply even after RRB entitlement.

2. Effective Date

The widow(er)'s DRCs are effective later of:

  • June 1978 or

  • Month of death.

3. Minimum Sole Survivor Rate

The law does not provide for an increase in the widow(er)'s MSSR. See C. below

C. PROCEDURE - MSSR VS WIB INCLUDING DRCS

To determine whether to pay the WIB with DRCs or the MSSR:

  • Determine MSSR.

  • Determine WIB and DRCs.

  • The higher is the new MBA.
