RS 01301.220 What Constitutes Filing of Some Proof of Support

POLICY

The proof must be a writing filed with SSA. It is not essential that the proof of support be on a prescribed form to be considered “filed.” The mailing date may be used as the date of filing where this would be to the dependent's advantage.

“Some proof of support” is more than a mere allegation of support or an affirmative answer to a lead question on an SSA application form. To constitute “some proof,” the writing must give facts regarding support. The statements should indicate that at least one-half of the individual's support came from the NH. Such a statement would be the minimum compliance with the support requirement. Additional development may have to be undertaken to actually prove one-half support.
