RS 01310.025 Claimant and Child Under Age 16 Living Together Temporarily - Policy

The child is in the claimant's care only if the child is:

  • in the claimant's care when they are apart, i.e., the claimant exercises parental control and responsibility, (see RS 01310.030); or

  • with the claimant for a period of at least 30 consecutive days and the claimant exercises parental control and responsibility. The child is considered to be in the claimant's care for the month the period began (except as provided in RS 00202.010 B.4.) or ended provided the child was in the claimant's care for at least one full day; i.e., a 24 hour day, of such month.

    NOTE: Temporarily living together includes the situation where the child is currently living with the claimant but lives with the other parent on an alternating schedule under a joint custody agreement.
