RS 01401.050 Development of Constructive Payment — Procedure - Wages

Develop constructive payments only if:

• •

  the PIA can be increased by $1 or more,

• •

  it is essential to obtain insured status or to establish a period of disability; or

• •

  the employee alleges constructive receipt is involved and insists on such development.

Develop for other periods only if the earnings record is incorrect and affects entitlement or the PIA.

If it is necessary to develop, obtain sufficient facts surrounding the payment for the period in question to make a supportable determination.
