RS 01901.220 Domestic Employment For a College Club, Sorority, or Fraternity

CITATIONS:

Section 210(a)(2) of the Social Security Act;
Regulation No.4, Sec. 404.1014.

A. POLICY

1. After 1950

Domestic service for local college clubs and local chapters of sororities or fraternities is excepted from employment when performed by a student who is enrolled and regularly attending classes at a school, college, or university.

2. 1940 Through 1950 Inclusive

Domestic service for a local college club or local chapter of a college fraternity or sorority is excepted from employment.

3. Before 1940

No specific exclusion applies.

NOTE: When engaged in commercial enterprise domestic service is not excluded.

B. DEFINITIONS

1. College Club

A local college club must have a membership composed mostly of students enrolled in the college or of persons directly connected with the college.

2. Fraternity or Sorority

A fraternity or sorority must have a membership composed mostly of students enrolled in the college.

NOTE: That some alumni or faculty members belong to the college club, fraternity, or sorority is immaterial. However, an alumni club or alumni chapter is not a college club, fraternity, or sorority, within the meaning of the law.
