RS 02101.034 Integration of Worker’s Services in the Business

A. Services integrated into the business

Direction and control are usually present if a worker integrates his or her services into the business operation of the employer or firm. To decide whether integration exists, determine:

  • the scope and function of the business; and

  • whether the services of the worker are merged into it.

When the success or continuation of a business depends to a substantial degree on the performance of certain kinds of services, the workers who perform those services must be subject to a certain amount of control by the business owner.
