RS 02505.015 When Employment Relationship (ERS) Terminates

A person earns wages only during the ERS. Therefore, do not consider wages as earned in a period after the ERS terminated. The ERS terminates in the last month that the employee performs physical services for the employer unless the employee expects to return to work or is subject to call to render additional service.

Accept the claimant’s or beneficiary’s allegation of the date the ERS terminated. If the beneficiary is unsure when the ERS terminated, confirm with the employer whether the ERS terminated, the employee plans to return to work or is subject to call.
