RS 02505.095 Guidelines for Determining Substantial Services

A. POLICY

Every self-employed beneficiary is presumed to have rendered SS during each month unless the beneficiary establishes otherwise as provided in Sec. 203(f)(4)(A) of the Act.

B. PROCEDURE

Evaluate each case on its merit as follows:

  • Give the beneficiary opportunity to submit supporting evidence.

  • Evaluate all the submitted evidence objectively in accordance with these rules and RS 02505.100.

  • Accept the submitted evidence if it is credible and sufficient to make a determination unless it is rebutted by other proofs.

  • Other evidence may be requested to rebut the claimant's but must be sufficient to disapprove the allegation. See guidelines in RS 02505.100.
