DI 12010.025 Action Following A Favorable Determination by the Disability Determination Service (DDS) in Informal Remand Cases

A. Policy following a favorable DDS determination

Following a favorable disability determination in informal remand cases, the DDS prepares and sends a notice of revised determination to the claimant. The claim folder(s) is then sent to the field office (FO) for action.

B. Procedure for processing fully favorable determination

Take the following actions when processing a fully favorable determination:

  1. 1. 

    Effectuate payment.

  2. 2. 

    Hold claim folder(s) for 45 days pending claimant's request to proceed with the hearing.

  3. 3. 

    If the claimant requests a hearing, obtain a signed SSA 795 (Statement of Claimant or Other Person) that indicates that the claimant wants to proceed with hearing. For paper cases, send the claim folder(s) and SSA 795 to the appropriate hearing office. For electronic cases follow instructions in DI 81010.141.

  4. 4. 

    After 45 days, if a hearing is not requested, route the claim folder(s) to the appropriate component for filing.
