DI 27540.020 Concurrent Title II/Title XVI Reopening Notices
In adverse reopening determinations in concurrent Title II/Title XVI claims, the due
process requirements applicable to Title XVI also apply to the Title II claim. These
cases require due process decision notices with benefit continuation language, where
applicable, or Goldberg/Kelly (GK) language for Title XVI non-medical adverse reopenings.
Benefit continuation, as provided under the Social Security Act (as amended by P.L.
98-460), requires the claimant to request benefit continuation. GK provisions automatically
continue benefits when the claimant appeals within 10 days. Title XVI recipients who
file a reconsideration request 11 or more days after, but within 60 days of receipt
of the determination notice, are also eligible to receive GK benefit continuation
until we make a reconsideration determination. See SI 02301.300 for more information on GK requirements.
