DI 28055.010 Effect of EPE on Period of Disability

A. Policy

The EPE affects the ending date of the period of disability for payments in some cases of persons who complete a 9-month TWP and engage in SGA. The period of disability for these persons ends with the last month disability cash benefits are payable.

1. Work-Related Ending

The period of disability of a disabled individual can end with the later  of the:

  • Second month after the month disability ceases due to SGA, or

  • Last month of payment for persons whose benefits are reinstated during the EPE after the SGA cessation.

2. Medical-Related Ending

If a person's impairment is not disabling at some time after the 9-month TWP is completed, the period of disability will end with the earlier of the:

  • Second month after the month the impairment is not disabling.

  • Last month of payment based on SGA.

B. Examples

1. Work-Related Endings

  1. a. 

    Disability ceased 1/89 due to SGA. Payments are made for the month of cessation and the 2 succeeding months, then placed in suspense status effective 4/89. The disabled person performs SGA throughout the reinstatement period. The period of disability ends 3/89,i.e., the second month after the month disability ceased due to SGA.

  2. b. 

    Disability ceased 1/89 due to SGA. Payments are made for the month of cessation and the 2 succeeding months, then placed in suspense status effective 4/89. Payments are reinstated 7/89 due to below SGA earnings, suspended 9/89 due to a return to SGA, reinstated 12/89 due to below SGA earnings, and suspended again in 3/90 due to SGA level work. SGA continued. The period of disability ends 2/90, i.e., the last month of payment after the SGA cessation.

2. Medical-Related Endings

  1. a. 

    Disability ceased 1/89 due to SGA. Payments are made for the month of cessation and the 2 succeeding months, then placed in suspense status effective 4/89. Payments are reinstated 7/89 due to below SGA earnings. The DDS finds that a disabling impairment no longer exists as of 10/89. The period of disability ends 12/89,i.e., the second month after the month the impairment is not disabling.

  2. b. 

    Disability ceased 1/89 due to SGA. Payments are made for the month of cessation and the 2 succeeding months, then placed in suspense status effective 4/89. Payments are reinstated 7/89 due to below SGA earnings and suspended 9/89 due to a return to SGA. SGA continued. The DDS finds that a disabling impairment no longer exists as of 10/89. The period of disability ends 8/89, i.e., the last month of payment based on SGA.
