DI 52750.020 Processing Center Case Processing Instructions
Review the evidence on file in accordance with existing instructions. In cases where an individual is found to be both illiterate and unable to communicate in English, apply the Martinez Ruling as explained in DI 52750.001. In an adverse determination where Martinez applies, the rationale should state that the Martinez Ruling has been considered in the decision. No special Martinez notices are required.
In preparing the SSA-831-U5/C5/SSA-833-U5/C5:
Enter listing code 536 in block 26 of the SSA-831-U5/C5 or block 34 of the SSA-833-U5/C5 in favorable claims where the favorable decision is due to the Martinez Ruling.
Enter listing code 537 in block 26 of the SSA-831-U5/C5 or block 34 of the SSA-833-U5/C5 where the claim has been considered under the Martinez Ruling, and an unfavorable decision has resulted.
B. Quality review
Cases adjudicated under the Martinez Ruling are subject to the usual quality review procedures (selection and review). No special review provisions have been established.
