DI 71001.070 Border Field Office (FO) and Disability Determination Services (DDS) Process for Reconsideration Requests Canadian Residents File in the United States

A. Border FO reconsideration processing procedures

The Disability Prototype process does not apply to Canadian claims. Do not use the prototype procedures for Canadian reconsideration claims processed in the following prototype states: Alaska, New York, and Michigan. All prototype states will make both the initial and reconsideration determination on reconsideration claims filed by residents of Canada.

1. Medical denials

The border field office (FO) takes reconsideration requests on initial disability determinations residents of Canada file in the United States. If the reconsideration request is on a medical determination, forward the reconsideration request to the DDS.

2. Non-medical denials

a. Affirmation

If the FO affirms the initial determination, forward the case to the Office of International Operations after adjudication.

b. Reversal

If the FO reverses the initial determination, forward the case to the DDS for an initial medical determination, according to the instructions in DI 81010.145.

B. DDS reconsideration processing procedures
